Fractional Ownership Insurance Agreement
This agreement explains how insurance is triggered when a fractional transfer is accepted, how the premium obligation follows the possessor, and what is covered under the policy.
⚠ Insurance activation is coming soon. The framework described below is built and ready — live cover will be activated once our insurance partner integration is finalised. Until then, no premiums are charged and no active policies are in force. This is a plain-English summary of the insurance framework that will apply to fractional ownership on Ownich. It does not constitute a standalone insurance contract. Full policy terms will be available on request from claims@ownich.io once live.
Transfer Acceptance → Insurance Activation Lifecycle
Insurance administration begins automatically the moment a fractional transfer is accepted. The sequence below describes every step from transfer acceptance to an active policy.
Transfer accepted
The receiving party (buyer or new co-owner) accepts the fractional transfer in the Ownich platform. This acceptance is the trigger event for insurance administration.
New possessor accepts insurance
Upon acceptance, the new possessor is presented with the insurance terms and must acknowledge them before the transfer is finalised. Declining insurance does not block the transfer but suspends cover until acceptance is confirmed.
Ownich calculates & requests premium
Ownich calculates the applicable premium based on the item's current valuation, ownership percentage, and selected billing cycle (monthly or annual). A payment request is issued to the possessor.
Payment succeeds
The possessor completes the premium payment. Ownich confirms receipt and records the payment against the certificate.
Insurance status becomes ACTIVE
Cover is activated and the certificate's insurance status is updated to ACTIVE. All co-owners are notified. The possessor's premium obligation continues on the agreed billing cycle until ownership changes or cover is terminated.
How Insurance Is Triggered
Insurance is activated automatically when a fractional transfer is accepted — not when it is initiated. The following conditions must all be met:
- A fractional transfer has been initiated by a current rights holder.
- The receiving party (buyer or new co-owner) has accepted the transfer.
- The new possessor has acknowledged the insurance terms.
- The first premium payment has been successfully processed.
The Possessor & Premium Obligation
The insurance premium obligation follows the possessor — the party who holds physical custody of the item or who holds the highest percentage of ownership. The possessor is determined as follows: • If one party has physical possession of the item, they are the possessor regardless of ownership percentage. • If no party has physical possession (e.g. the item is in storage or custody), the party with the highest ownership percentage is deemed the possessor and holds the premium obligation. • If two or more parties hold equal percentages and none has physical possession, Ownich will designate the possessor based on the transfer history and notify all parties. The premium obligation transfers automatically whenever ownership percentages change or physical possession changes hands. The outgoing possessor's obligation ends on the date the transfer is accepted; the incoming possessor's obligation begins on the same date.
If all fractional parties decline physical possession, Ownich may suggest a custody method (e.g. third-party storage). The party who accepts custody under that arrangement becomes the possessor and assumes the premium obligation.
Premium Structure
- Premiums are calculated as a percentage of the item's current Ownich valuation.
- Billing is monthly or annual — the possessor selects the cycle at activation.
- Annual billing attracts a discount equivalent to two months' premium.
- A 7-day grace period applies to missed payments before cover is suspended.
- Cover is suspended during arrears; no new fractional transfers are permitted while cover is suspended.
- The premium obligation transfers automatically when the possessor changes.
What Is Covered
Cover applies to the item registered under the certificate for the duration of the active policy.
Theft
Loss of the item due to verified theft, supported by a police report and certificate evidence.
Accidental damage
Physical damage caused by an unforeseen accident while in the possessor's custody.
Loss in transit
Loss during a documented transfer of physical custody between co-owners.
Proportional payout
Settlements are paid proportionally to each rights holder's ownership stake at the time of the claim.
What Is Not Covered
- Damage caused intentionally by any rights holder.
- Loss or damage occurring while cover is suspended due to arrears.
- Items not registered under a valid, non-deleted Ownich certificate.
- Wear and tear, gradual deterioration, or inherent defects.
- Loss or damage arising from war, terrorism, or acts of God.
- Items subject to an active dispute or freeze at the time of the claim.
Your Obligations as Possessor
As the possessor, you agree to the following obligations for the duration of your premium obligation:
Keep premiums current
Pay premiums on time. A 7-day grace period applies; after that, cover is suspended and no new transfers are permitted.
Notify Ownich of custody changes
Inform Ownich promptly if physical possession of the item changes hands, so the possessor record can be updated.
Report incidents promptly
Report any theft, damage, or loss within 14 days of the incident. Late reporting may affect your claim.
Maintain certificate accuracy
Ensure the certificate record accurately reflects the item's condition and any material changes.
How to Make a Claim
Report the incident
Email claims@ownich.io within 14 days of the incident. Include your certificate ID (OWN-YYYY-XXXXXX) and a brief description.
Submit evidence
Upload supporting evidence via your dashboard: police report (theft), photographs (damage), or courier documentation (transit loss).
Assessment
Ownich will assess the claim within 10 business days. We may request additional information.
Settlement
If approved, settlement is paid proportionally to each rights holder's ownership stake within 14 business days of approval.
Rights of All Co-Owners
All fractional co-owners have the following rights regardless of whether they are the possessor:
- The right to be notified when insurance status changes (ACTIVE, SUSPENDED, LAPSED).
- The right to receive a proportional share of any insurance settlement.
- The right to raise a dispute if they believe a claim outcome is incorrect.
- The right to view the full insurance and transfer history of the certificate.
Custody Provision
If all fractional parties decline physical possession of the item, Ownich may suggest a custody method to ensure the item is properly stored and insured. The custody process is as follows:
- 1Ownich notifies all co-owners that no possessor has been designated.
- 2Ownich proposes one or more custody options (e.g. third-party storage, escrow).
- 3Co-owners vote on the preferred custody method within 14 days.
- 4The party who accepts custody under the agreed arrangement becomes the possessor and assumes the premium obligation.
- 5If no agreement is reached within 14 days, Ownich may suspend new transfers on the certificate until custody is resolved.
When Cover Ends
Cover ends automatically when:
- The possessor cancels the policy with 30 days' written notice.
- The premium lapses after the 7-day grace period and is not reinstated.
- The certificate is deleted or the item is fully transferred to a single owner.
- All co-owners agree in writing to terminate cover.
Cover may be reinstated after lapse by paying all outstanding premiums plus a reinstatement fee. Reinstatement is at Ownich's discretion.
